By using HireQualify, you agree to these terms. Please read them carefully.
These Terms of Service ("Terms") govern your use of HireQualify's AI-powered interview platform ("Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance and Eligibility
By using HireQualify, you represent and warrant that:
- You are at least 18 years old and have the legal capacity to enter into contracts
- You have the authority to bind your organization to these Terms
- Your use complies with all applicable laws and regulations
- You are not located in a country subject to U.S. embargo or designated as terrorist-supporting
2. Account Registration and Security
Account Creation
To use our Service, you must create an account with accurate and complete information. You agree to:
- Provide truthful, current, and complete registration information
- Maintain and update your information to keep it accurate
- Keep your login credentials confidential and secure
- Immediately notify us of any unauthorized account access
Account Responsibility
You are responsible for all activities that occur under your account, regardless of whether the activities are authorized by you. We are not liable for any loss or damage from unauthorized account use.
3. Service Description and Usage
What We Provide
HireQualify offers:
- AI-powered video and phone interview services
- Automated interview scheduling and candidate management
- AI-generated scorecards and transcripts
- API access for platform integration
- Analytics and reporting features
Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
4. Acceptable Use Policy
Permitted Use
You may use HireQualify solely for lawful business purposes related to recruitment and hiring. All use must comply with applicable employment laws and regulations.
Prohibited Uses
You agree NOT to:
- Use the Service for any discriminatory or illegal hiring practices
- Attempt to reverse engineer, decompile, or hack our systems
- Use automated systems to access the Service beyond API limits
- Share or resell access to your account
- Upload malicious code or interfere with Service operation
- Violate any third-party rights or privacy
- Use the Service to harass, abuse, or harm candidates
Warning: Violation of this policy may result in immediate account termination without refund and potential legal action.
5. Pricing, Payment, and Refunds
Subscription Plans
- Subscription: $149/month for 2 roles and 25 interviews
- Additional roles: $79/month per role (includes 25 interviews)
- Overage: $4 per interview beyond included amount
- Pay-as-you-go: $4 per interview or discounted bundles
Billing and Payment
- Subscriptions are billed monthly in advance
- All payments are processed securely through Stripe
- Prices are in USD and exclude applicable taxes
- Failed payments may result in service suspension
Refund Policy
We offer a 7-day money-back guarantee for new subscriptions. After 7 days, payments are non-refundable. Unused interview credits do not roll over to the next billing period.
6. Intellectual Property Rights
Our Property
All content, features, and functionality of HireQualify, including but not limited to text, graphics, logos, icons, images, audio clips, software, and AI models, are the exclusive property of HireQualify, Inc. and are protected by international copyright, trademark, and other intellectual property laws.
Your Content
You retain ownership of all content you upload to HireQualify ("User Content"). By uploading content, you grant us:
- A worldwide, non-exclusive license to use, process, and store your content to provide the Service
- The right to generate AI insights and scorecards based on your interviews
- Permission to use anonymized, aggregated data to improve our Service
Feedback
Any feedback, suggestions, or ideas you provide about the Service become our property and may be used without compensation or attribution to you.
7. Privacy and Data Protection
Your use of HireQualify is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you acknowledge that:
- You have obtained necessary consents from candidates for recording and processing
- You comply with all applicable data protection laws (GDPR, CCPA, etc.)
- You will handle candidate data responsibly and securely
- You will notify candidates about the use of AI in the interview process
8. Disclaimers and Limitations of Liability
Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
No Guarantee
We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy or reliability of AI-generated content, including interview scorecards and insights.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount paid by you in the past 12 months
- We are not responsible for hiring decisions made based on our Service
Note: Some jurisdictions do not allow limitation of certain warranties or damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless HireQualify, Inc., its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or related to:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
- Your User Content or hiring practices
10. Termination
Termination by You
You may terminate your account at any time through your account settings. Termination does not entitle you to any refunds for unused subscription periods or interview credits.
Termination by Us
We may suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms or engage in any conduct that we determine, in our sole discretion, to be inappropriate or harmful.
Effect of Termination
Upon termination:
- Your access to the Service will cease immediately
- We may delete your data according to our data retention policy
- All licenses granted to you will terminate
- Provisions that by their nature should survive will remain in effect
11. Dispute Resolution
Informal Resolution
Before filing a claim, you agree to try to resolve any dispute informally by contacting us at legal@hirequalify.com. We'll try to resolve the dispute informally for 30 days.
Binding Arbitration
If informal resolution fails, any dispute will be resolved through binding arbitration under the rules of the American Arbitration Association. The arbitration will be conducted in San Francisco, California.
Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
12. General Provisions
Governing Law
These Terms are governed by the laws of California, USA, without regard to conflict of law principles.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HireQualify.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
Waiver
Our failure to enforce any right or provision will not be considered a waiver of those rights.
Assignment
You may not assign or transfer these Terms. We may assign our rights to any of our affiliates or successors.
13. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we'll notify you via email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes constitutes acceptance of the new Terms.
